Mt Eden Tennis Club Incorporated (“the Club”) Membership Terms and Conditions

1. MEMBERSHIP

1.1. Eligibility: Membership is open to individuals of all ages and skill levels. Minors (under 18 years old) must have a parent or guardian’s consent to become a member.

1.2. Application: All prospective members must complete a membership form online through the Club’s website and pay the required fees. By becoming a member you are deemed to have accepted these terms and conditions.

1.3. Membership Fees: Membership fees must be paid in full upon joining the Club and renewed annually. Fees are non-refundable, unless otherwise agreed by the Club in its sole discretion.

1.4. Membership Benefits: Members have access to the Club facilities, courts, and scheduled events/coaching. Some events or activities may incur additional fees.

1.5. Conduct: Members are expected to behave respectfully towards others, follow the Club rules, and maintain sportsmanlike conduct on and off the court. Unacceptable conduct includes behaviour and language that is offensive or insulting, unsafe, or unnecessarily distracts or inconveniences others. This expectation extends to all persons present at the Club, and all members representing the Club in any way, either at the Club or at another tennis club, whether they are playing, supporting, coaching or acting as an official.

1.6. Tennis NZ Code of Conduct: Members should refer to Tennis New Zealand Code of Conduct and where appropriate Junior/Senior Tennis Interclub Rules.

2. COURT USAGE

2.1. Court Usage: Courts are available on a first-come first-served basis. Priority is given to club organised events, club coaching and interclub competitions. The Club coach has the right to determine how the courts will be used and direct members as required.

2.2. Guest Policy: Members may bring guests, subject to a guest fee. Guests must abide by all of the Club rules and regulations. Members are responsible for the behaviour and conduct of their guests.

3. PRIVACY AND SECURITY CAMERAS

3.1. Collection of Information: The Club collects personal information from members, including but not limited to names, contact details, and payment information, for the purpose of managing memberships and providing services.

3.2. Use of Information: Personal information will be used solely for activities related to the Club, including communication about events, membership updates, and payment processing.

3.3. Data Protection: The Club is committed to protecting members’ personal information in accordance with applicable privacy laws. The Club will not share personal information with third parties without member consent, except as required by law or for processing payments.

3.4. Access and Correction: Members have the right to access their personal information held by the Club and request corrections if necessary. Requests should be made in writing to the Club’s administration.

3.5. Security Cameras: For the safety and security of our members and guests, the Club utilises security cameras at the Club premises. These cameras are used for security purposes and to monitor activities and live streaming within the Club’s property.

3.6. Location: Cameras are located in public areas on the outdoor tennis courts.

3.7. Consent: By entering the Club premises, you acknowledge that you are aware of and consent to the use of video surveillance cameras for the purposes of safety, security, and marketing. You understand that footage may be recorded, stored, and used for legitimate purposes, including but not limited to incident investigation and reporting, crime prevention, prosecution and live streaming on the Club’s website.

3.8. Compliance: The Club is committed to protecting the privacy of its members and guests. Footage will be handled in accordance with applicable laws and regulations, including the Privacy Act 2020. Access to stored security camera footage will be restricted to authorised personnel only.

4. EQUIPMENT AND SAFETY

4.1. Equipment: Members must use appropriate tennis equipment and attire. The Club is not responsible for the loss or damage of personal belongings. Acceptable clothing comprises of tennis-specific clothing or moisture-wicking athletic wear. Acceptable footwear comprises of non-marking tennis shoes.

4.2. Safety Rules: Members must follow all safety rules and instructions provided by the Club staff. The Club is not liable for injuries sustained while using the facilities.

4.3. No Smoking: In the interest of public health, smoking is prohibited at all times on the Club’s premises. This includes, but is not limited to the Courts and surrounding areas, the clubhouse and buildings and all outdoor areas within the Club boundaries. “Smoking”; includes the use of cigarettes, cigars, pipes, and any other smoking, including electrical devices.

5. CLUB EVENTS AND COMPETITIONS

5.1. Participation: Members are encouraged to participate in the Club’s events and competitions. Registration and additional fees (such as ball fees) may apply.

5.2. Conduct: All participants must adhere to any additional rules that apply to a particular event or competition.

6. LIABILITY AND WAIVER

6.1. Assumption of Risk: By becoming a member, individuals acknowledge the inherent risks associated with playing tennis and using the Club facilities.

6.2. Liability Waiver: The Club is not responsible for any injuries, accidents, or loss of property that occur on its premises. Members waive any claims against the Club and its staff.

6.3. Indemnity: Members agree to indemnify and hold harmless the Club, its employees, agents, and representatives from any claims, damages, liabilities, and expenses (including legal fees) arising out of or related to their use of the Club’s facilities, participation in any activities, or breach of these terms and conditions.

7. BREACH OF TERMS AND CONDITONS AND TERMINATION OF MEMBERSHIP

7.1. Termination by the Club: The Club reserves the right to terminate a membership without refund if a member violates the Club’s terms and conditions, rules or engages in misconduct. The Club may also take appropriate disciplinary action, including but not limited to a verbal warning, written warning, and suspension from club activities. The Club reserves all right to take appropriate legal action against a member for any breach of these terms and conditions.

7.2. Voluntary Termination: Members may terminate their membership at any time by notifying the Club in writing. Membership fees are non-refundable (unless agreed otherwise by the Club in its sole discretion).

7.3. Grievances: Members may submit grievances via email to the Club management. Grievances will be addressed by the Mt Eden Tennis Club committee within a reasonable time period.

8. AMENDMENTS

8.1. Changes to Terms and Conditions: The Club reserves the right to amend these terms and conditions at any time. Members will be notified of any changes via email or the Club’s notice board.

9. GOVERNING LAW

9.1. Jurisdiction: These terms and conditions are governed by the laws of New Zealand.
